These Terms & Conditions ("T & C") of the site www.vanillavice.com regulates the relations between the Users/Registered Users/Customers of this site and its owner, the brand Vanilla Vice, property of Catia Andreia Teles Ribeiro de Almeida, with headquarters in Praceta Capitao Americo dos Santos, nr 8 - 3 Esq, 2735-049 Agualva-Cacem, Portugal, e NIF 216467519., hereinafter also designated as "Vanilla Vice".

Vanilla Vice provides to the users of the site a platform for online shopping of fashion and lifestyle accessories.

The access and use, in any way, of www.vanillavice.com, well as the purchase of available products, implies the total acceptance of these T&C and the adopted Privacy Policy, without any reservations.

Vanilla Vice reserves the right to periodically revise or alter these T&C, so  it is recommended that users consult this page frequently.

This site and all its contents are exclusive property of Vanilla Vice.

1. Registration

Users who wish to purchase products through the www.vanillavice.com website must meet the requirements and complete the registration, expressly stating that the user has become aware and accepts these and the processing of personal data by clicking "I agree that my personal data be saved in accordance with the Privacy Policy."

Individuals may register at www.vanillavice.com if they are 18 years old or emancipated, and have the full use of their capabilities, as well as legal persons who have authorized representatives.

Registration on www.vanillavice.com site, however, does not give a right to the user.

Users are responsible for the veracity of the information transmitted to Vanilla Vice and for updating the same information whenever it suffered any alteration.

Vanilla Vice reserves the right to terminate any user account for which there make false, outdated or not in accordance with these T&C.

Users are also solely responsible for the security of the password they define to access their user accounts.

All personal information voluntarily provided upon registration or collected through automated procedures are subjected to security measures to prevent access, unauthorized use and disclosure, as the provisions of the Privacy Policy. 

 

2. Payment

Payment can be made by PayPal. Credit cards data, provided by Registered User, are directly registered in the database of the administrators of the card, which does not allow access to such information by third parties. Vanilla Vice does not have access to any information about the data of the credit card used and is not responsible for any difficulties in making the payment.

If the Registered User chooses to use Paypal, providing the username and password of their Paypal account at the time of confirmation of purchase, will be required. In this case, Vanilla Vice does not have access to any information about the data of the credit card used and is not responsible for any difficulties in making the payment.

 

3. Shipment

Our team processes orders as soon as possible. All orders submitted and payed up to 6 p.m. (UTC +1 London Time Zone) will be processed on the following business day. Therefore, orders submitted on Friday will be processed on next Monday.

Once confirmed the order and made ​​the payment of the products by the Registered User, Vanilla Vice will send a message confirming receipt of the order and payment.

If, after payment of products, Vanilla Vice verifies any situation of unavailability, the payment will be automatically credited back to the Customer, through the payment method used by the Customer, the amount corresponding to the product(s) not available and will be sent an alert message.

 

4. Delivery of Products

With the exception of extraordinary circumstances, the product(s) purchased will be delivered within a maximum period defined for each country or region from the date on which the order is shipped. 

Portugal (except Islands): 1 to 5 business days.

Azores and Madeira: 5 to 10 business days.

Europe: 5 to 10 business days.

Rest of World: 5 to 15 business days.

Delays in delivery of orders may will be due to:

- Customization of products.

- Specialized articles.

- Cases of force/circumstances of domestic law.

- Carrier strike.

- Customs procedures.

- Sales season or special promotions.

If, for some reason, is not possible to fulfil the specified deadline for delivery, Vanilla Vice will inform the Customer of that fact and will give him the option of keep the order, establishing new delivery date, or cancel the purchase being, in this case, refunded the amount spent.

In any case, it should be acknowledged that deliveries are made on business days, so not made on Saturdays, Sundays and holidays. If the deadline for delivery has fallen on one of these days, it will be automatically extended until the next business day.

For purposes of the T&C, the delivery date of any product will declared when signing the acknowledgment of receipt of the products at the agreed delivery address.

The delivery time count starts after the communication of payment approval, by the financial institution, to Vanilla Vice and after validation of personal data of Registered User / Customer.

 

5. Transmission Risk

The risks to which may be subjected the products will be the purchaser’s responsibility from the time of delivery, i.e., from the moment the customer becomes owner of those products.

 

6. Returns/Cancellation of Purchase

Vanilla Vice sells only items in perfect condition and always confirms the condition of the items before they are sent to the client.

We offer our customers quality products, always seeking partnerships with the best suppliers in the various categories that we sell. However, product returns are predictable situations.

If the customer wants to return the product within the first 14 days of ownership, they may do so. The product must be returned in the same packaging it was delivered.

To proceed with the return please contact us by email info@vanillavice.com, indicating that you want to return the product, always indicating the order number and we will send you, immediately, all the data and necessary steps to the return. The cost of returning the products  is at your own risk, with the exception of defective products.

After Vanilla Vice receive and examining the article, Customer will be informed about the right or not to return the amounts paid. The refund will be carried out as soon as possible within the period of 30 business days from the date of returning the product. The return of the amounts paid will be made using the same payment method used by the Customer when purchasing.

There shall be no refund of products which are not in the same condition they were received, which have been worn beyond simply opening of the packaging or which are returned after the time limit set forth in these T&C (14 business days).

If the return is not in accordance with these T&C, the product will be returned to the Customer with a copy of the evaluation performed and in this case, it's not due any compensation to the Customer.

Earrings, hair accessories, headphones with earpiece, lingerie, vouchers and gift cards are not eligible for return as well as products acquired through promotions such as, Private Sales, Sale or Special Offers.

If you want to make a change to the order, you first must make a return and then make a new order. 

 

7. Defective Products

Upon receiving the product, if it is considered that it is not in accordance with the Terms and Conditions of Sale, you should contact Vanilla Vice, within a maximum of 14 business days, through the email address info@vanillavice.com, informing us about the defect. Should indicate in the email the invoice number, reference and/or name of the article and the defect.

You can return the product through any postal service delivery.

After careful evaluation of the product you would like to return/replace, you will receive a notice via e-mail at the earliest possible date. If there is room to return or replace the product, it will be accomplished within 15 business days from the date that e-mail message confirming the return or replacement of the product was sending.

If the return is not in accordance with these T&C, the product will be returned to the Customer with a copy of the evaluation performed and, in this case, it's not due any compensation to the Customer.

The amounts paid for products returned defective will be refunded in full, including all shipping costs. The refund will be made ​​via the same payment method used to purchase.

So that we may proceed with the return shipping cost, we need you to send us a copy or scan of the order proof of shipping (invoice must be requested at the postal delivery service upon delivery of the order).

All the rights recognised by the law will be safeguarded.

 

8. Warranty/Service After Sales

Vanilla Vice is totally alien to guarantees and after-sales services, except as described in paragraph 7 of these T&C.

 

9. Data Protection

Vanilla Vice respects all applicable laws regarding the protection of personal data. Users/Registered Users/Clients, should regularly consult the Privacy Policy and make sure they are in accordance with it.  

In case of misuse of the site www.vanillavice.com or in case of suspected practice of an act not permitted, under applicable law or these T&C, by any User/Registered User/Customer, Vanilla Vice can communicate data of the User/Registered User/Customer to competent authorities.

 

10. Deleting Registered Users

In case of misuse of the site www.vanillavice.com, of proven fraud, participation by obtaining benefit or advantage unlawfully, of violation or breach of any provision contained in these T&C or applicable legislation by any User/Registered User/Customer, Vanilla Vice reserves the right to, at any time, suspend or terminate User/Registered User/Customer access to the site in question.

In the event of the occurrence of these facts, the suspension or cancellation of access is done without any compensation being due to User/Registered User/Customer. 

 

11. Responsibility

Vanilla Vice is not responsible for access or navigation failures arising from circumstances to their will and control including, without limitation, Internet failures in general, power outages, bad electronic and/or physical functioning of any telecommunications network failures, interruptions or suspensions of connection and software and/or hardware failures of the User/Registered User/Customer, as well as outages scheduled maintenance, upgrade and configuration settings of the site www.popthebubblestore.com.

It is responsibility of the User/Registered User/Customer:

(i) keep the environment of your computers and other devices to access the site secure, making use of specific tools such as antivirus, firewall, among others, in order to contribute to the prevention of electronic risks;

(ii) use operating systems and browsers updated and efficient to make full use of the site;

(iii) equip themselves and be responsible for computers and hardware devices needed to access the site as well as the access of computers and devices to the Internet;

(iv) the use, custody, maintenance and confidentiality of all passwords that are transferred to it to make purchases on the site.

 

12. Rights of Vanilla Vice

The elements of www.vanillavice.com site were specifically designed to promote sales of products therethrough. Thus, all elements of the www.vanillavice.com site, whether visual or sonorous (including software) are protected by copyright, prohibiting its reproduction, publication, transmission, modification or distribution by any means.

 

13. Entire Agreement

The present T&C are the only ones applicable to the use and purchase of products through www.vanillavice.com site, overwriting any other conditions.

Consequently, Users/Registered Users/Clients that access the site www.vanillavice.com and/or purchase products through it, agree to be bound by these T&C. 

 

14. Law

The present T&C shall be governed by and construed in accordance with applicable Portuguese legislation. In case of dispute, shall be competent Courts of the District of Lisbon.
